Taxpayers charged for detectives’ steak roastBy Sebastian del Marmol You’d have thought that Coral Gables Police would have learned their lesson about the unwise use of the city’s controversial P(urchasing) cards. After all it was its inappropriate use by a police major in 2007 that first brought attention to the relatively unregulated use of the P-card in the City Beautiful which eventually brought down former City Manager David Brown.
You might have thought it. But you could be wrong.
The Gazette has learned that there is currently an Internal Affairs investigation into a $248.58 P-card purchase made at BJ’s Wholesale Club in
The stated purpose of the purchase: “Divisional working lunch meeting.”
And what a lunch it was. Listed on the receipts are steaks, barbeque sauce, burgers, hot dogs, buns and spareribs.
Who attended the lunch, where it was held, who did the cooking – the grocery list makes it appear obvious that this was a legitimate barbecue – and how they managed to get any work done while cooking and consuming ribs, burgers, hot dogs and steaks is in question.
Neither police spokesperson nor Internal Affairs representatives comment on active cases.
City Manager Maria Alberro Jimenez – who saw close up the damage that illicit P-card purchases had on the career of her former boss – did confirm that there was an investigation into the matter taking place but said she would not comment until such time as that investigation was completed. Several commissioners queried about the case also admitted to having heard talk of the investigation but could not provide any specific details.
It is unclear how the issue managed to come before Internal Affairs but what is known is that this is not the first time police have had mishaps resulting from the problematic p-cards.
Late in 2007, a police major purchased numerous watches for his subordinates as a Christmas gift. Although he repaid the department, it was clearly against card guidelines and led to a closer examination of other abuses and ultimately to the former city manager’s purchase of alcohol during business lunches.
The maelstrom which resulted from the original investigation – including Brown’s foolhardy attempt to cover his tracks by forging official receipts – eventually led to the former city manager’s demise. Comments

This is more of the same under the "weakest ever" leadership our department has had. Naue is a fine person, however, he does not run the show. He is being run by two losers, Ginn and Hudak, aka Gand H, or GH (garbage hustlers). The show is run by his incompetent and a__-kissing Majors, Ginn and Hudak, both useless pieces of s___ that have no respect for Interim Chief Naue. Hudak recently got slapped on the wrist for fu_____ up royally, one of his many. The offense was serious enough to have warranted a demotion, however, Naue is running scared and losing on his run to be named permanently. I heard that he is hot water when a resident documented the lies he and Naue told the City Manager and Commissioners about the area patrol fiasco. I know the resident is right because I prepared some of the garbage for Hudak when my boss told me to stretch the facts. Do not blame the rest of my fellow officers about this as we are not pleased with what is going on. The fine women and men of this department are proud of what we do and who we serve. We will be there in two minutes, even if Hudak fudges the numbers and lies about them. At least one loser, Gibbons, got his tail whipped and is out of the picture. Good riddance, you fat big-mouthed pig. He and Hudak, two real specimens. Residents, do not let up and demand the best, as we are the best, however, leadership under Naue and his buddies stinks. We trust Ms. Jimenez will put an end to this as we approach the Chief's to-be or not-to-be date.

Sgt. Mosquera is an excellent officer who has excelled in every unit he has been a member of. Naue, Hudak, and Ginn are all exceptional officers and extremely competent leaders who have excelled in every aspect of their careers. Gibbons has done more for the FOP then any of the previous presidents. This expenditure is not far fetched; I know Ginn and Mosquera would not be foolish enough to try anything illegal. The unwarranted attack on the aforementioned Officers is not only slanderous it is also cowardly. Stop airing your personal attacks to further your own agenda.

I am a CEO of a major company, and I served my country in the Armed Forces. The $250.00 dollar bill to feed these employees is petit. I spend over $10,000.00 a year on a Christmas party for my employees, this actually boost moral, and brings them together. While in the Armed Forces we spend millions a year to boost moral for the men and women who serve our country. $250.00 dollar lunch for the men and women who put their lives on the line on a daily basis is worth it! I actually spend more then that to feed my family every week. I say keep up the good work Coral Gables Police!

Hey Bozo perfect name for you, it is even more important for non-profit orginizations to promote teamwork and good will. Since most officers did not take an oath to get rich but to help people they dont even know, these small events are needed. When you are in a profession where everyday you deal with people who are in trouble or are trying to victimize other innocent people, you need time to smile and laugh and vent. Just remember when you are in trouble and need real help, it is not Volsky, Gazette reporters, or even the people in city hall that are hauling ass to get to you, to help you. In reading some of these comments it seems that the purchase of the food was warranted to bring the division together. You will always have a few disgruntled employees that will never be satisfied. This person named Hudak is not even named in the article? And as for “Hey Bozo”, your employees are the most valuable asset of your company/police department. The person in charge of the division decided to use these funds to bring his division together. It’s not like he tried to hide it. My company is with-in the city limits and I live with-in the city limits. I pay a lot of taxes to live here and in my opinion the funds were used appropriately. I’m not sure what your agenda is, but in investigating something so petit that would be a theft a tax payers’ money. That is if in fact that they did not try to hide the issue.

Now would be the time for the Chief to stand up and take this as an opportunity to demonstrate that he is the leader of the organization and explain right here in this forum that there are funds specifically budgeted for “food for human consumption” for employees. Out of the many millions of dollars in the overall budget there is a thousand or so dollars in each division budgeted to feed employees. Unfortunately he doesn’t understand that standing up and explaining oneself or the actions of the employees is necessary every now and then. Having said that, it is pretty stupid with all of the attention lately on P-cards to make such a purchase. Allowed or not, now is not the time to draw attention to the department in any way. Stupid stupid decision on all fronts. What’s even more shameful is what is being posted here by people from within. You are embarrassing the police department and all of the infighting at the top is hardly a secret to anyone. Again, time for the Chief and his staff to put an end to it. Unfortunately, because of the level of squalor and how long it has been going on now, this will not happen. History has proven time and time again that organizations which get to this point of no return cannot be repaired except by cleaning house. This is what happened at Building and Zoning, City Hall, and in times past at the police department and many corporations. As is usual, these types of places are full of cowards. People who lack the necessary strength to speak up on their own with their own face. Instead they flock to these places to throw stones at people they otherwise wouldnt dare confront in public, much less in private. Their egos stoked by the backscratching of pseudo journalists who run what is referred to as a "rag" newspaper, they feign morality to any who would listen in forums such as these. They attack the characters of good men such as Major Hudak and Major Ginn, while cozying up in the blanket of anonymity of the internet. Coral Gables residents who move and operate in the business world each and every day laugh and scoff at the continual nonsense and petty bickering these morally bankrupt zeros purvey. They snicker at the senseless shows of piety over $250 dollars spent on Coral Gables finest- as if the City was down to its last dollar. This is a piece from the Herald.com, the Neighbors section, about a Major. As I said before, a slap on the wrist is all he got, and now it's all been swept under the rug. If any one that does not hold a brass badge were to do something like this, they would not receive just a slap on the wrist.

A member of the top brass at the Coral Gables Police department, investigated for and cleared of possible perjury charges, was slapped on the wrist this month by the city for having filed an affidavit with false information.
The complaint filed last year by the attorney for two police officers who were disciplined by Maj. Ed Hudak, former chief of the internal affairs division and who later sued the city saying they were not disciplined in the required timely manner. While the Miami-Dade State Attorney's Office said there was not sufficient evidence that Hudak, who now heads the city's patrol department, committed perjury, the 22-year veteran got a written reprimand Jan. 9 for violating rule 1.03 of the department's rules and regulations. ''Personnel at each level of the department will have the authority and responsibility commensurate with their position to make decisions necessary for the effective execution of their duties,'' the rule states. ``All personnel are fully accountable for the use or misuse of authority.'' Attorney Michael Pancier, who represented Sgt. Alan Matas and Lt. Alexander Roffe in the lawsuit, said Hudak's sworn affidavit was ``false and misleading.'' In the affidavit, Hudak said he met with the two subordinates and the police union president to discuss the investigation and possible disciplinary action May. 17, 2006 -- when the union president was out of town. Pancier filed a complaint with the department last March, after the civil case was resolved, saying Hudak may have committed ``official misconduct, perjury or obstruction of justice by submitting a false and misleading affidavit.'' Lt. Theresa Silverio-Molina told the Miami Herald last week that the department immediately forwarded the allegation to the state attorney's office. Assistant State Attorney Johnette Hardiman said in her close-out memo that the date of the meeting and who was present were not relevant to the case. ``It is immaterial to the litigation. Materiality is required to establish perjury.'' And official misconduct can only be established if it were proved that Hudak had a corrupt intent to obtain a benefit or cause harm to another through the affidavit, Hardiman wrote. They did not file criminal charges, but sent the case back to the city to proceed administratively, Silverio-Molina said, adding that a charge of violating the personal accountability rule was sustained. ''He admitted he signed the affidavit after not thoroughly reading it,'' Silverio-Molina said. Hudak said Friday there were several revisions to the affidavit, which was prepared by a paralegal, and that he was working on several cases at the same time. ''There were a lot of corrections made,'' Hudak said, adding that he had instructed the paralegal to write ''on or about May 17'' because he was not sure of the date. 'She just put `on.' She did not put 'or about,' '' Hudak said. ``I did not catch it. It was not an accurate reflection of what I told her. ``Did I sign an improper document? Yes, absolutely. And it will never happen again. I learned from it. I'm probably one of the bigger proofreaders in the department and I'm in the largest division. ''I learned if you are doing those affidavits you should do them yourself,'' he added. ``What I got at minimum was what I deserved. When you are looking at documents like that, you can't leave any stone unturned.''

The reason H can't do any work is because he's constantly reading the blog and more concerned about who writes what than with trying to find criminals and wrongdoers. Wow, I have never seen such a turnout on this blog on any issue. Boy, I do not Hudak or Ginn, however, it has brought out beast in a hell of a lot of people, especially within the department. I believe this article has stirred a bee's nest and only indicates that the City Beautiful's Police Department is boiling and needs to be cooled off. As a resident, it seems the leaders are worthless and we need to ensure they are quickly displaced. I will call the City Manager's office and write to my commissioners and mayor to express my displeasure at what seems to be a disjointed and leaderless department. I am so sorry Chief Hammerschmidt passed away. May he rest in peace as he was class all the way. The present leaders seem to be opportunists and careless clowns that are her to suck blood at our expense. Back in the 70'S AND 80'S the CGPD was known for being a bunch of loosers sleeping on duty, showing for work drunk, porkin' dispatchers in the gym and such. Funny thing is that almost 40 years later nothing much has changed. The PD Majors' of the 70's were incompetent crooks who falsified police reports, obstructed justice by destroying police reports and traffic citations for their town buddies, stole evidence out of the evidence lockers and generally used the department for their own selfish gains and benefit. Here we are almost 40 years later and the same shit is going on by a whole new crew. Abusing their authority, misapropriating funds, and covering up for each other. They are all running around like chickens getting ready to lay an egg; sucking every hole they get a liplock onto so they can get the Chiefs job! What a disgrace! These are the people in charge? The citizens of this city should take to the streets in massive protest. How about the Mayor and council members? Will anyone please step up to the plate?

As a curious taxpayer and observer of the city's mishaps I would like to ask Mr. Hudak what has been the results of his investigations into the Building and Zoning Department.
1) Has he found evidence of wrongdoing against Margaret? 2) Has he found evidence of wrongdoing among others in her staff? 3) Why did the state drop all the charges against ADPT? 4) Why did Margaret sign an affidavit giving a former employee 4000 hours in overtime hours?

The Bond Buyer: The Daily Newspaper of Public Finance Vallejo Union Digs in Heels Plans to Appeal Court-Sanctioned Rejection of Contract Bond Buyer | Friday, September 4, 2009 By Andrew Ward SAN FRANCISCO — In an action that stands to drag out Vallejo, Calif.’s already 16-month-old bankruptcy proceedings, the International Brotherhood of Electrical Workers plans to appeal a court ruling allowing the city to reject its collective bargaining agreements. Michael McManus, chief judge of U.S. Bankruptcy Court for the Eastern District of California, earlier this week allowed the city to reject the union contract. A lawyer for the IBEW, which represents frontline non-public safety workers, said the union plans to appeal the ruling to the Ninth Circuit Court of Appeals. “This is the first time a court has ever really rejected a public employee collective bargaining agreement,” said union bankruptcy attorney Dean Gloster, of Farella Braun + Martel LLP in San Francisco. He said the precedent is bad for public workers across the country, unfair to Vallejo’s lowest-paid workers, and based on an incorrect interpretation of the U.S. bankruptcy code. The union’s legal team can appeal to the Ninth Circuit or the Bankruptcy Appellate Panel in Pasadena, Calif. Gloster said he plans to file with the Ninth Circuit because its judges are more accustomed to dealing with labor law and may be more willing to question the idea of throwing out a contract than bankruptcy judges. McManus subjected the city’s motion to reject the labor contracts to a three-part test defined in the U.S. Supreme Court’s 1984 case National Labor Relations Board v. Bildisco & Bildisco. The Bildisco standard required the city to prove that the contract was burdensome; rejection of the contract was equitable to the parties to the bankruptcy; and the parties had tried to negotiate a solution and were unlikely to reach an agreement. McManus this week said Vallejo met that standard. If his ruling stands, the IBEW will have to renegotiate its contract, which was good through June 30, 2010. The city is pushing for new contracts because it believes overly generous labor agreements bankrupted it. Labor costs account for about three-fourths of the Vallejo general fund, or about $60 million a year. By contrast, the city’s general fund municipal market debt is small. It has just over $50 million of certificates of participation outstanding. Gloster said the U.S. Congress overturned the Bildisco precedent when it enacted Section 1113 of the Bankruptcy Code, which says a company can void labor contracts only if that action is necessary to prevent liquidation of the business. Gloster also argued that the bankruptcy court couldn’t simply allow the city to ignore California’s public sector labor laws. McManus rejected those arguments in a legal memorandum he issued in March. At the time, he wrote that the Congress had declined to incorporate the changes into the Chapter 9 municipal bankruptcy law. He also said the state had waived local labor law when it authorized its municipalities to file for Chapter 9 protection. The March memo was his interpretation of the law. He applied it to the Vallejo case by rejecting the IBEW’s contract earlier this week after forcing the parties into mediation with a bankruptcy judge for several months. Vallejo, which has four public employee unions, reached voluntary agreements on new contracts with the Vallejo Police Officers Association and the Confidential, Administrative, Managerial, and Professional Association. The International Association of Firefighters last month agreed to rejection of their contracts and to begin an expedited schedule of negotiations that will either yield a new contract agreement or a contract that’s imposed in binding arbitration within several months. Vallejo, a city of 117,000 people, sought Chapter 9 bankruptcy protection in May 2008. It’s the biggest municipal bankruptcy since Orange County, Calif.’s in 1994. “There aren’t many municipal bankruptcies, and I think Vallejo is one of the first — if not the first — to really concentrate on employment contracts,” said James Spiotto, head of the head of the special litigation, bankruptcy, and workout group at Chapman and Cutler LLP in Chicago. He agrees with McManus’ interpretation of the law. He said the judge’s ruling is “unusual, but not unanticipated” because of the law and the economic conditions of local governments. Spiotto said he hopes the ruling and Vallejo’s experience will show public officials and public employee unions that they need to negotiate seriously to avoid bankruptcy. Vallejo’s lawyer, Marc Levinson of Orrick. Herrington & Sutcliffe LLP, said the IBEW’s appeal is a waste of time and money for both the city and its workers. He said the city has already spent millions on legal fees that could have been put to better use paying firefighters and IBEW members. “If they’re going to appeal it, which is their right, it’s just more time, more money, more delay,” he said. Levinson said it’s better to start negotiating a plan to adjust Vallejo’s debts. A “plan of adjustment” is a legal term for a schedule of payments that the economically battered city can actually afford to pay after the bankruptcy. It’s the last stage in a bankruptcy, and requires the parties to come to an agreement on the damages that unions and bondholders will be paid for their losses under the bankruptcy. “We still have to fight about damages, which could be substantial, but at least we’re at the point now where we really have to move forward on the formulation and negotiation of a plan,” Levinson said. Bankruptcy damages are generally paid at pennies on the dollar from the leftover funds in a bankruptcy. The payments are often stretched out over years or decades. Gloster said the IBEW will continue to negotiate on a new labor contract, even as it appeals McManus’ ruling to higher courts. He said the city could end the case now if it would offer its front-line workers the same sort of terms as it offered managers. His comments suggest the union’s appeal may be both a principled stance on the sanctity of its contracts and a way of keeping pressure on the city to offer the IBEW the best deal possible. Gloster said he couldn’t discuss the precise details of the labor negotiations, but said the main point of contention for the IBEW is that its workers — Vallejo’s lowest paid — are being offered less generous health benefits than police, firefighters, and management employees. © 2009 The Bond Buyer and SourceMedia Inc., All rights reserved.
